US v. Robison, 05-17019
Defendants' convictions for roles in a Clean Water Act conspiracy and for substantive violations of the CWA are vacated where the trial court's definition of "navigable waters" in the jury charge was erroneous under Rapanos v. U.S. 126 S. Ct. 2208 (2006), and the government has not shown that the error was harmless.
