United States Eleventh Circuit

US v. Jones, 06-15203

Conviction and sentence for possession of ammunition by a convicted felon and possession of ammunition by a controlled substance user are reversed where: 1) instructions given by the district court in response to the jury's announcement of deadlock constituted a plainly incorrect statement of law to the jury; 2) this error affected defendant's substantial rights; and 3) such an error seriously affects the fairness, integrity, and public reputation of judicial proceedings.
