Millennium Partners, L.P. v. Colmar Storage, LLC, 05-14914
In subrogation dispute arising from the flooding of a coffee storage warehouse, judgments in favor of plaintiffs are affirmed where the district court did not err in: 1) denying defendant's motion to amend; 2) admitting evidence regarding the denial of a building permit and a subsequent remedial measure; 3) denying defendant's motion for judgment as a matter of law; 4) awarding additurs; 5) granting a new trial regarding actual damages; and 6) granting defendants prejudgment interest from the date of loss.
