US v. Knight, 05-14537

Conviction of alien resident for improperly voting in a federal election in violation of 18 U.S.C. section 611(a) is affirmed over claims that: 1) section 611(a) is unconstitutional because it fails to incorporate a mens rea, and the district court improperly incorporated a general intent mens rea into the offense; and 2) instructions given to the grand jury that indicted defendant violated the Fifth Amendment.
