Albra v. Advan, Inc., 06-15969
In suit alleging violations of the Americans with Disabilities Act and the Florida Omnibus AIDS Act, dismissal of complaint is affirmed as: 1) individuals are not amenable to private suit for violating the ADA's anti-retaliation provision where the act or practice opposed by the plaintiff is made unlawful by the ADA provisions concerning employment; and 2) individuals are not amenable to private suit for violating section 760.50(3)(b) of the FOAA.
