United States Eleventh Circuit
US v. Presley, 05-16778, 05-16779
Revocation of supervised release and conviction of possessing a firearm as a convicted felon are affirmed over claims that: 1) the district court lacked jurisdiction to revoke defendant's release after its term was over, as the allegations behind the warrant and summons issued to begin the revocation proceeding were not sworn; and 2) the district court failed to inform the jury that it could acquit him if his possession of the firearm was necessary.
