United States Eleventh Circuit

Rowe v. Jones, 06-12296

In case involving the Inmate Welfare Fund, created following settlement of prisoner civil rights class action suit, dismissal of defendants' motion to terminate a permanent plan for charitable donations from fund is reversed as the court order establishing the charitable trust and requiring Fund payments to that trust, and the consent decree continuing the charitable trust, are terminable under the Prison Litigation Reform Act.
