In gender and age discrimination suit, dismissal of sexual harassment and state law claims is affirmed over primary claims that: 1) defendant failed to articulate a "legitimate" reason for not promoting plaintiff; 2) plaintiff is entitled to a new trial or an amended judgment based on the court's erroneous mixed-motive jury instruction, dismissal of her federal and state claims, and bifurcation of the trial; and 3) plaintiff consented to the magistrate judge's jurisdiction over her first, but not her second, lawsuit.
