In Re: Clerici, 06-11141

Granting of government application for judicial assistance to foreign tribunals, resulting in appointment of Assistant U.S. Attorney to obtain sworn answers from appellant to questions posed in Panamanian Court's letter rogatory, is affirmed as: 1) the Panamanian Court's request for assistance in obtaining appellant's sworn answers for use in the proceeding in Panama was proper under 28 U.S.C. section 1782; 2) the district court had authority to grant the application; 3) appellant has not shown that the district court abused its discretion; and 4) Rule 69(a), Fed. R. Civ. P., does not bar the discovery authorized in this case.
