Baldwin v. Blue Cross/Blue Shield of Ala., 05-15619

In suit alleging sexual harassment and retaliation, including claims that supervisor frequently used profanity, referred to staff using profane terms, and propositioned plaintiff, summary judgment for defendant is affirmed as: 1) defendant showed not only that it fulfilled its responsibility to prevent or correct workplace harassment, but also that the plaintiff failed to promptly report alleged harassment; and 2) defendant had a non-retaliatory reason for firing plaintiff in that plaintiff refused to cooperate in the defendant's reasonable attempt to solve the problem.
