United States Eleventh Circuit
Andujar v. Rodriguez, 05-17162
In suit alleging defendant paramedics acted with deliberate indifference to plaintiff's serious medical needs after plaintiff jumped from a truck he and accomplices had hijacked at gunpoint and was thereafter bitten by a police dog, denial of summary judgment to defendants is reversed as: 1) plaintiff cannot establish that defendants acted with deliberate indifference to his medical needs; and 2) even if defendants's actions were impermissible, their actions did not violate clearly established statutory or constitutional rights of which a reasonable person would have known.
