United States Eleventh Circuit

Green v. Holland, 06-10241

In ERISA action seeking to recover accrued interest on disability benefits, summary judgment for defendants is affirmed where: 1) plaintiff's attempt to allege a cause of action for interest under ERISA is precluded by 11th Circuit precedent; and 2) plaintiff is not entitled to interest under ERISA, as he has not presented evidence that defendants violated ERISA or breached the terms of the pension plan in processing his disability claim.
