Bayshore Ford Trucks Sales, Inc. v. Ford Motor Co., 05-14254
In a class action alleging breach of auto franchise agreement, denial of plaintiffs' motion to dismiss case against defendant in order to litigate their claims as class members in an Ohio case, and injunction against one of the plaintiffs from prosecuting the Ohio class action, is vacated as to the injunction and upheld as to denial of motion to dismiss. Appeal of order on in limine motion is dismissed for lack of pendent appellate jurisdiction.
