US v. McInteer, 04-16167
Dismmissal of qui tam action brought by relator physician against two other physicians and several health care providers under the False Claims Act, is affirmed as: 1) the complaint's allegations of fraud have not been made with the "particularity" required by Federal Rule of Civil Procedure 9(b); and 2) the district court did not abuse its discretion in not granting the relator leave to amend his complaint to cure such deficiency.
