US v. Milkintas, 05-13256

Convictions for conspiracy to possess and possession with intent to distribute cocaine while aboard a vessel subject to U.S. jurisdiction are affirmed over claims that: 1) there was insufficient evidence of his knowing and willful possession of cocaine with the intent to distribute and insufficient evidence of his knowing participation in a drug conspiracy to sustain the convictions; and 2) the district court erred by denying defendant safety-valve consideration under 18 U.S.C. section 3553(f), U.S.S.G. sections 5C1.2 and 2D1.1(b)(7).
