United States Eleventh Circuit
Federated Rural Elec. Ins. Exch. v. R.D. Moody & Assocs., Inc., 05-17184
Summary judgment issued in subrogation case, holding that plaintiff's subrogation claim is barred, in part, by the Florida Insurance Guaranty Association Act, but that FIGA may not preclude plaintiff from recovering the portion of its damages exceeding the amount of defendants' liability insurance coverage, is reversed as Georgia law controls this dispute, and the district court erred in applying Florida law.
