United States Eleventh Circuit

Grossman v. McDonough, 05-11150

Denial of habeas petition of death row inmate is affirmed over claims that: 1) petitioner's Sixth Amendment right to confrontation was violated when the state trial court refused to sever his case from his co-defendant, whose confession -- which also implicated petitioner -- was introduced at trial, albeit against only the co-defendant; 2) the state impermissibly withheld Brady material concerning three prosecution witnesses; and 3) that petitioner received ineffective assistance of counsel at the penalty phase of his capital trial.
