United States Eleventh Circuit

Gulf States Reorg. Group, Inc. v. Nucor Corp., 05-15976

Summary judgment for defendants, on claims of violations of Sections 1 and 2 of the Sherman Act, and dismissal with prejudice -- based on plaintiff's lack of Article III standing, lack of antitrust standing for failing to demonstrate antitrust injury, and defendants compliance with antitrust laws by increasing competition in a bankruptcy auction -- is reversed as plaintiff properly demonstrated both causation and antitrust injury.
