Valle v. Secretary for the Dep't of Corr., 05-15724

Denial of habeas petition challenging convictions and death sentence is affirmed over claims that petitioner's rights: 1) to the effective assistance of counsel at resentencing was denied due to counsels' presentation of model prisoner evidence; 2) under Batson v. Kentucky were violated; 3) under the Fifth and Fourteenth Amendments were violated when the trial court denied his motions to suppress incriminating statements; and 4) to Due Process and Equal Protection were violated based on the manner in which the jury was selected.
