United States Eleventh Circuit

Miller v. Scottsdale Ins. Co., 04-11660

Summary judgment in favor of defendant, based statutory construction that defendant insurer could cancel policy as to different insureds at different times, is reversed as the plain language of section 627.848, Florida Statutes, contemplates a single cancellation date for an insurance policy as a whole and all statutory, regulatory, or contractual requirements for cancellation must be satisfied before a policy may be canceled.
