United States Eleventh Circuit

US v. Faust, 05-11329

Conviction and 210-month sentence for possession with intent to distribute cocaine is affirmed over claims that: 1) there is insufficient evidence to support his conviction; 2) the district court erred in admitting evidence under Federal Rule of Evidence 404(b) as the Government failed to provide adequate notice of its intent to introduce such evidence; and 3) the district court violated his Sixth Amendment right to a jury trial by enhancing his sentence based on conduct for which he was acquitted.
