Sentence for illegal entry into the U.S. is affirmed over claims that: 1) the district court erroneously denied defendant a four-level downward departure under the early disposition program; and 2) the enhancement of defendant's sentence based on his prior convictions violated the Fifth and Sixth Amendments.
