Esponda v. U.S. Attorney Gen., 05-13875

Summary dismissal of an alien's appeal for failure to file a supplemental brief despite the fact that the alien outlined claims in detail on the Notice of Appeal form is reversed and remanded where conflicting regulations should be resolved in the alien's favor and C.F.R. section 1003.3(b) shielded the alien from dismissal because the claims were outlined on the Notice.
