Morillo-Cedron v. District Dir. for U.S. Citizenship & Immigration Servs., 05-14047

Award of attorney's fees and expenses to plaintiffs under the Equal Access to Justice Act is reversed where the district court erred in concluding that Buckhannon Bd. & Care Home Inc., v. West Va. Dep't of Health and Human Res., 532 U.S. 598 (2001), did not apply to the EAJA, and therefore, erred in finding that the plaintiffs were entitled to an award of costs and attorney's fees under the "catalyst theory."
