United States Eleventh Circuit

US v. Dowd, 05-15067

Convictions and sentence for robbing a U.S. postmaster and related conversion and firearms charges are affirmed over claims that: 1) the district court abused its discretion in denying motion to sever a felon in possession count; 2) oral and written custodial statements to inspectors were involuntary and violated Miranda; 3) Double Jeopardy was violated at sentencing; 4) defendant should not have been sentenced as an armed career criminal under the ACCA; 5) resentencing is warranted because trial judge was replaced at sentencing; and 6) the sentence was unreasonable under 18 U.S.C. section 3553.
