United States Eleventh Circuit

Camp Legal Def. Fund Inc. v. City of Atlanta, 05-12114

Moratorium on issuance of outdoor festival permits is upheld where, as to all but one provision of the Atlanta Outdoor Festivals Ordinance of 2003, there is either no jurisdiction to consider plaintiff's challenge, or judgment in favor of defendant must be upheld. However, as provisions regarding the exemption for city-sponsored events grant unbridled discretion to city officials, judgment is reversed in part and remanded.
