Miedema v. Maytag Corp., 06-12430
Order granting plaintiff's motion to remand to state court for lack of subject matter jurisdiction is affirmed over claims that: 1) the district court erred by placing the burden of proving subject matter jurisdiction on defendant and resolving all doubts in favor of remand; 2) even if defendant did have this burden, the district court applied too high a standard of proof with respect to CAFA's amount in controversy requirement; and 3) the district court erroneously relied upon a post-removal amended complaint in reaching its decision.
