Christopher v. State of Florida, 04-16319
Judgment in favor of one defendant, following jury trial finding both defendants liable for using excessive force against plaintiff, is reversed where sufficient conflict existed in the evidence presented to permit rational jurors to reach differing decisions. Granting of new trial for other defendant is affirmed where the district court did not abuse its discretion in finding circumstances warranted a new trial.
