United States Eleventh Circuit

Permanent injunction against defendants to remove evolution sticker from inside front cover of science textbooks is vacated where there are significant evidentiary gaps in the record, coupled with the problematic nature of some of the district court's factfindings, prevent proper appellate review of the merits of the important constitutional issues raised and requires remand for new evidentiary proceedings.
