In Re: Superior Constr. Co.., 05-10110
Judgment for plaintiffs, in case where pleasure boat crashed into defendant's stationary barge, is affirmed over claims that the district court erroneously: 1) found the barge obstructed navigation in violation of 33 U.S.C. section 409; 2) placed a presumption of fault on defendant under the Pennsylvania Rule; 3) determined defendant failed to show its violation could not have been a cause of the crash; 4) refused to apportion a percentage of fault to plaintiffs; 5) determined total damages for two plaintiffs.
