Giddens v. Equitable Life Assurance Soc'y of the U.S., 05-10816

In case involving disability benefits under two insurance policies, grant of partial summary judgment in favor of plaintiff is affirmed, and denial plaintiff's remaining grounds for summary judgment is reversed over argument that Georgia law compels the interpretation that total disability exists only where the insured is unable to perform all of the substantial, material duties of his occupation.
