Sierra Club v. Georgia Power Co., 05-11314

Grant of partial summary judgment in favor of plaintiffs, based on alleged violations of the Clean Air Act, 42 U.S.C. sections 7401-7671q, at a large power plant owned by defendant, is reversed where the district court should have allowed defendant invoke as a defense a startup, shutdown, or malfunction (SSM) rule approved by the EPA.
