United States Eleventh Circuit
Heffner v. Blue Cross & Blue Shield of Alabama, Inc., 04-15477
Certification of plaintiff class was an abuse of discretion where: 1) in order for plaintiffs to prevail on their ERISA claims each plaintiff must prove reliance on health plan's summary plan descriptions thereby making relief inappropriate for the class as a whole; and 2) the district court failed to address separately the plaintiffs' breach of fiduciary claim.
