Peebles v. Merrill Lynch, Pierce, Fenner & Smith Inc., 04-16304

Denial of plaintiff's petition to vacate a zero dollar arbitration award following defendant's removal to federal court is affirmed where the district court properly found it had subject matter jurisdiction and there was no error in the denial of the petition to vacate the award in the underlying case involving securities fraud.
