Plaintiff-EEOC may proceed with a Title VII enforcement action charging defendant with racial harassment, notwithstanding a similar action brought by individual plaintiffs alleging the same harassment by the same defendant, on grounds that there is no privity between plaintiff-EEOC and the individual plaintiffs in the prior action.
