United States Eleventh Circuit
JEFFERSON v. FOUNTAIN, 02-16059
Grant of habeas corpus relief to defendant, on grounds that his counsel was ineffective for failing to file a motion to suppress, is reversed where, in evaluating prejudice, a court should not consider an error by counsel that merely deprived the defendant of the chance to have the state make an error in his favor.
