United States Eleventh Circuit

SME RACKS, INC. v. SISTEMAS MECANICOS PARA ELECTRONICA, 03-12572

Dismissal of plaintiffs' suit, arising from the purchase of allegedly defective goods from an international seller, is reversed where the district court abused its discretion in dismissing the case on grounds of forum non conveniens by failing to apply the strong presumption that a United States Citizen will not be ousted from the courts of this country.
