MOYE, O'BRIEN, ETC. v. NAT'L RR. PASSENGER CORP., 03-14264

The Court reversed the district court's finding that the plaintiff's Freedom of Information Act (FOIA) requests made to defendant were not protected, deciding that the material sought is protected from disclosure by the deliberative process privilege codified in Exemption 5 of the FOIA.
