United States Eleventh Circuit

LIFESTAR AMBULANCE SERV., INC. v. US, 03-11392

Dispute concerning the Medicare reimbursement rates for ambulance service suppliers is dismissed for lack of mandamus jurisdiction. The fact that resort to administrative remedies is "futile" does not justify the effective nullification of Medicare's exhaustion requirement.
