United States Eleventh Circuit

BURK v. AUGUSTA-RICHMOND COUNTY, 03-11756

Defendant's ordinance, requiring a permit for public demonstrations in groups of five or more people, targets political expression and does not survive strict scrutiny. The ordinance's indemnification requirement is standardless and grants the county attorney unconstitutional discretion over permitting decisions.
