United States Eleventh Circuit

PRIME INS. SYNDICATE, INC. v. B.J. HANDLEY TRUCKING, INC., 03-12823

Defendants were properly denied attorneys' fees. District court did not err in applying lex loci contractus to determine that Alabama law governed this insurance contract; under Alabama law, an insured may not recover attorneys' fees incurred in a declaratory judgment action to determine coverage under a liability policy.
