United States Eleventh Circuit
KMS REST. CORP. v. WENDY'S INT'L, INC., 03-10759
Summary judgment for defendant is vacated; the fact that defendant did not act solely out of malice in interfering with plaintiff's contract with a franchisee does not preclude a finding of tortious interference under Florida law. Improper methods may support a tortious interference claim even when the defendant did not act solely out of malice.
