COLONIAL LIFE & ACCIDENT INS. CO. v. HARTFORD FIRE INS. CO., 03-11688

Breach of the enhanced duty of good faith sounds in contract under Alabama law, and Alabama applies the doctrine of lex loci contractus. Plaintiff's breach of good faith claim, regarding insurance contracts made in South Carolina, must therefore be decided under South Carolina law; the fact that under South Carolina law such claims sound in tort does not warrant dismissal of the case.
