BARGER v. CITY OF CARTERSVILLE, 02-14820

Grant of summary judgment to defendant, dismissing plaintiff's employment discrimination claims, is affirmed where plaintiff is barred from raising the issue collateral estoppel for the first time on appeal and is judicially estopped from asserting the monetary damages on discrimination claims she failed to disclose in her bankruptcy petition. However, the court is reversed where it judicially estopped plaintiff from seeking injunctive relief.
