US v. DURAN, 02-14977

Retired boxer Roberto Duran may reclaim his championship boxing belts, as judgment on the jury's verdict awarding him rightful ownership is affirmed. Although an apology for a theft was not properly admitted under the hearsay exception set out in Federal Rule of Evidence 803(3), the testimony concerning the apology as a statement against interest by a declarant unavailable at trial was admissible under Rule 804(b)(3).
