MANDERS v. LEE, 01-13606

In this section 1983 excessive force case against a sheriff in his official capacity, the sheriff functions as an "arm of the State" in establishing use-of-force policy at the jail and in training and disciplining his deputies in that regard, and is entitled to Eleventh Amendment immunity for these particular functions.
