A mutual legal assistance treaty between the US and Canada obligates the US, at the request of Canada, to issue subpoenas to compel the testimony of witnesses in a criminal investigation prior to the filing of formal charges. Thus, a Canadian request for assistance should have been granted and the subpoenas should not have been quashed by the district court.
