United States Eleventh Circuit
US v. BALLINGER, 01-14872/15080
A federal statute proscribing destruction to religious real property, 18 U.S.C. section 247, is not unconstitutional under the Commerce Clause, but as applied to defendant's convictions for church arson, the connections of each church to interstate commerce are too insubstantial to satisfy the jurisdictional element of section 247.
