The correct standard to be applied by district courts in reviewing Merit Systems Protection Board determinations for non-discrimination claims is an arbitrary and capricious standard of review. Summary judgment for employer on Title VII, ADEA, Whistleblower Protection Act and unlawful termination claims is affirmed.
