BROWARD GARDENS TENANTS ASS'N v. US ENVTL. PROT. AGENCY, 01-15117
A suit alleging numerous deficiencies in a cleanup plan was a "challenge" to the cleanup falling outside the scope of section 113(h) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Section 113(h) does not apply to constitutional claims challenging the adequacy of a remedial plan.
